Kiln

Terms of Service

Effective 9 October 2026

1. About These Terms

Kiln ("the Service") is provided by JMWD Solutions Ltd, a company registered in Scotland with company number SC760915, whose registered office is at 3 Smith Crescent, Clydebank G81 6AD. In these Terms, "we" and "us" mean JMWD Solutions Ltd. By creating an account with Kiln, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

Kiln is for anyone who wants a website, whether for a business, an organisation or personal use. "You" means the person or organisation that holds the Kiln account.

If you use Kiln as a consumer (for purposes that are wholly or mainly outside your trade, business, craft or profession), section 17 applies to you as well. It sets out your legal rights. Where section 17 and the rest of these Terms say different things, section 17 wins.

These Terms include the Data Processing Schedule (Schedule 1) and refer to our Privacy Policy. If these Terms and the Data Processing Schedule conflict about personal data you collect through your site, the Data Processing Schedule wins.

2. Definitions

  • Account: your account on Kiln, and any team logins under it.
  • Your Site: the website Kiln hosts for you, on a kiln.link address, on your own domain, or both.
  • Your Visitors: people who visit Your Site, send you a message through it or create an account on it.
  • Your Customers: Your Visitors who book or pay through Your Site, if you switch on bookings or payments.
  • Your Content: everything you or your team put into Kiln: text, images, settings, and the information Your Visitors give you through Your Site.
  • Plan: the monthly subscription you choose.
  • Add-on: an optional extra, billed monthly alongside your Plan.
  • Bookings and payments features: the booking diary and taking payments through Stripe. They are optional. Sections marked [Bookings and payments only] apply only if you switch them on.
  • Stripe: Stripe Payments UK Ltd and its affiliates, who process payments for you and for us.

3. Your Account

You must be at least 18 to open an Account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you think someone else has used your account, reset your password straight away.

Keep your contact details accurate, so we can reach you. If you add team members, you decide who gets a login and you are responsible for what they do. Owner accounts must use the multi-factor sign-in Kiln asks for.

If you open an Account for an organisation, you confirm you have authority to accept these Terms for it.

4. Acceptable Use

You agree not to use the Service to distribute unlawful, harmful, or fraudulent content, to infringe third-party rights, or to attempt to compromise the integrity of the platform or its users.

In particular, you must not:

  • send spam, or email people who have not asked to hear from you;
  • upload content you do not have the right to use;
  • publish someone else's personal information without a lawful reason;
  • probe, scan or load-test the Service, or try to get round its security or usage limits;
  • resell or sublicense the Service without our written agreement.

5. The Service

Kiln gives you a website, and optional bookings and payments features. Features change over time. We may add, change or remove features. If we remove a feature you pay for separately, we will tell you in advance and stop charging for it. Section 17 sets out extra protections if you are a consumer.

Some features connect to services you choose to use, such as a calendar or a social media account. When you connect one, you also agree to that provider's terms, and you tell us to send it the data the feature needs (see the Privacy Policy). You can disconnect at any time.

6. Subscription and Billing

Paid plans are billed monthly in advance through Stripe. Prices are shown on our pricing page and when you subscribe.

JMWD Solutions Ltd is not registered for VAT, so we do not charge VAT. If we register for VAT, we will give you at least 30 days' notice by email. From then on, VAT will be added to prices for business users, and prices for consumers will be shown including VAT.

You may cancel at any time from your billing settings. Your cancellation takes effect at the end of the month you have already paid for, and your Plan is not renewed. You can undo the cancellation before then. There is no minimum term.

We do not refund part-used months, except where the law requires a refund. If you are a consumer, you keep your rights in section 17, including your 14-day cancellation right.

If a payment fails, we will tell you and Stripe will retry. If it is still unpaid after a grace period of at least 14 days, we may suspend your Account until it is paid.

We may change our prices. We will give you at least 30 days' notice by email before a price change affects you. If you do not want to pay the new price, you can cancel before it takes effect.

7. Add-Ons and Address-Lookup Credits

Add-ons are optional and are billed monthly with your Plan. If you remove an add-on, it stays active until the end of the period you have paid for. We do not refund or charge for part months. The address-lookups add-on grants an allowance of address lookups each month while it is active. Unused lookups carry forward and do not expire while the add-on remains active. Additional lookups may be purchased in one-off bundles; purchased credits are prepaid and are not refundable once bought. Granted and purchased credits are consumed one per successful address lookup. When your balance reaches zero, the address-lookup feature is suspended until credits are added; no other part of the Service is affected. On cancellation or termination, any remaining credits are forfeited. Vehicle registration lookups, where enabled, are not metered and consume no credits.

If you are a consumer, section 17.2 applies to credit bundles as well.

8. Taking Payments Through Stripe Connect [Bookings and payments only]

Your Stripe account. To take payments from Your Customers, you open your own Stripe account through Kiln. At the Stripe connection step, you accept the Stripe Connected Account Agreement (https://stripe.com/connect-account/legal), which includes the Stripe Services Agreement, directly with Stripe. Stripe decides whether to accept you and checks your identity. It holds your funds and pays them out to you. You can sign in to your own Stripe Dashboard at any time.

Stripe accepts individuals and sole traders as well as companies. When you take payments through Stripe, Stripe treats you as selling. That is true even if you use Kiln for personal reasons.

Fees. Stripe charges its processing fees to your Stripe account directly. Kiln also takes a platform fee: a percentage of each payment taken through your Account. The percentage is shown on the Billing page in Settings. When you refund a payment through Kiln, we refund our platform fee on it too.

Losses. Your Stripe account is set up so that you pay Stripe's fees and Stripe, not Kiln, covers negative balances. Disputes and chargebacks are between you, Your Customer and Stripe. You must respond to them through your Stripe Dashboard.

We are not part of your sale. When Your Customer books or buys from you, the contract is between you and Your Customer. Kiln and JMWD Solutions Ltd are not a party to it. You are responsible for:

  • what you provide, and its quality and safety;
  • your prices, deposits and what you charge;
  • your own cancellation, rescheduling and refund policy, and applying it;
  • if you sell to the public, your own consumer-law obligations to Your Customers, including the information and cancellation rights in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015;
  • your own terms and privacy policy for Your Customers;
  • your tax, VAT and insurance.

Kiln gives you tools to set these up (for example, a cancellation window and a deposit policy). Choosing the right settings is up to you.

Refunds to Your Customers. Kiln never refunds a customer automatically when they cancel. You decide and issue refunds yourself from your dashboard.

9. Your Content

You retain ownership of all content you upload to the Service. You grant Kiln a limited licence to store, display, and deliver that content as necessary to operate the Service on your behalf.

You are responsible for Your Content. You confirm you have the right to use it, and that it does not break the law or anyone's rights. We may remove content that breaks these Terms, and we will tell you when we do.

Kiln's own software, themes, templates and branding belong to us. You may use them only on Your Site while you subscribe.

If you use the AI writing assistant, check what it writes before you publish it. You are responsible for the text you publish, including legal pages it drafts for you.

10. Personal Data You Collect

If Your Site collects information from Your Visitors (through a contact form, customer accounts or bookings), we hold it for you as your processor. Schedule 1 (Data Processing Schedule) sets out how we handle it. That applies to every Account, including personal sites.

If you collect data for a business, club or organisation, you are its controller under data protection law. Put a privacy policy on Your Site that tells Your Visitors how you use their data. If you run a purely personal site, data protection law may not apply to you (the "household exemption"), but we still protect the data as Schedule 1 says.

11. Domains

Every Site gets a free address on kiln.link. You can also connect a domain you own. You keep ownership of your domain. You stay responsible for registering it, renewing it and paying for it with your registrar. We do not buy or register domains for you.

If you leave, you keep your content and your domain. When you ask, we will send you an export of Your Content within 30 days of your request. Booking and customer data comes as CSV files. You can then point your domain somewhere else. When your Account closes, we stop serving your domain and remove it from our systems. The kiln.link address stays ours and is not transferable.

12. Availability and Maintenance

We aim to keep Kiln available at all times, but we do not promise it will never be interrupted. We may need to carry out maintenance. Where we can, we will do it at quiet times and give notice of planned work that will cause downtime. We do not offer an uptime commitment or service credits. Kiln depends on other providers, such as our hosting, network and payment providers. For business users, we are not responsible for their outages. Consumers keep the rights in section 17.

13. Suspension and Termination

You may cancel your account at any time (see section 6).

We may suspend or end your Account only for a valid reason:

  • you have seriously or repeatedly broken these Terms;
  • your use harms the Service, its users or third parties, or breaks the law;
  • your subscription is unpaid after the grace period (see section 6);
  • we are required to by law or by a regulator.

Unless the problem is urgent (for example a security risk, illegal content or harm to others), we will warn you first and give you a reasonable chance to put it right. We may also stop offering the Service to everyone, with at least 90 days' notice. If we end your Account through no fault of yours, we will refund any fees you have paid for the period after it ends.

While suspended, your logins and Your Site may stop working, and Your Customers will not be able to book.

What happens to your data. After your Account closes, we keep your data for 90 days. During that time you can ask for an export (see section 11). After 90 days we delete everything, except financial records such as payments, invoices and the financial details of bookings, which we keep for six years because the law requires it. Deleted data stays in our encrypted backups for up to 7 days before it is overwritten.

Sections that by their nature should survive termination (including 8, 9, 14, 16 and 17) continue to apply.

14. Our Liability

This section applies in full to business users. If you are a consumer, section 17.4 applies instead of the second, third and fourth paragraphs.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Kiln shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service.

In particular, we are not liable for loss of profit, revenue, bookings, goodwill or data (other than our duty to restore data from our backups where we can).

Our total liability to you for all claims in any 12-month period is limited to the greater of (a) the fees you paid us in the 12 months before the event that caused the claim, including platform fees, and (b) £100.

If you are a business user, you agree to cover our reasonable losses if a third party (including one of Your Customers) makes a claim against us because of Your Content, what you provide to Your Customers, or your breach of these Terms.

15. Changes to These Terms

We may change these Terms only for a valid reason: a change in the law or regulator guidance, a change to the Service or how we provide it, a change in our costs or providers, or to make them clearer. For a change that matters to you, we will email the account owner at least 30 days before it takes effect, and you will be asked to accept the new version. If you do not agree, you can cancel before then. If you are a consumer, any money you have paid for the period after the change will be refunded. Changes needed urgently for legal or security reasons may take effect sooner, with as much notice as we can give. The effective date is shown at the top of these Terms.

16. General

You may not transfer your Account to someone else without our agreement. We may transfer our rights under these Terms to a company that takes over Kiln. We will tell you if we do, and it will not reduce your rights. If a court finds part of these Terms unenforceable, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. These Terms are the whole agreement between us about the Service.

Governing law. These Terms are governed by the law of Scotland. The courts of Scotland have exclusive jurisdiction over any dispute with a business user. If you are a consumer, see section 17.6.

17. If You Are a Consumer

This section is written to be read on its own. It applies if you use Kiln wholly or mainly for purposes outside your trade, business, craft or profession, and you live in the UK. Nothing in these Terms takes away or limits your statutory rights as a consumer. For more about your rights, see Citizens Advice (citizensadvice.org.uk) or, in Scotland, Advice Direct Scotland (consumeradvice.scot).

17.1 What we promise

Under the Consumer Rights Act 2015, we must provide the Service with reasonable care and skill. What we tell you about the Service before you sign up, in writing or on our website, also forms part of our contract with you. If we do not provide the Service with reasonable care and skill, you can ask us to put it right. If we cannot do that within a reasonable time and without significant inconvenience to you, you can ask for an appropriate price reduction, which can be up to a full refund.

17.2 Your 14-day right to cancel

You can cancel your subscription within 14 days of the day you sign up, without giving a reason.

If you cancel within those 14 days, we will refund everything you have paid, even if you have already started using the Service.

You can also cancel a one-off address-lookup credit bundle within 14 days of the day you buy it, and we will refund what you paid for it.

How to cancel. Email hello@kiln.solutions, telling us clearly that you want to cancel. You can use this wording, but you do not have to:

To JMWD Solutions Ltd, hello@kiln.solutions:
I hereby give notice that I cancel my contract for the supply of the following service: Kiln subscription.
Ordered on: [date]. Name: [your name]. Address: [your address]. Account email: [email]. Date: [date].

To meet the deadline, send your message before the 14 days end. We will refund you within 14 days of receiving it, to the card you paid with. There is no fee for the refund.

17.3 After the 14 days

You can cancel at any time from your billing settings. Your Plan then runs to the end of the month you have paid for and does not renew. We do not charge a cancellation fee.

17.4 Our liability to you

If we break these Terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result of that. Loss is foreseeable if it is obvious it would happen, or if both of us knew it might happen when you signed up. We are not responsible for loss that is not foreseeable.

We are not liable for business losses (such as lost profit or lost business opportunity), because a consumer account is for personal use.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights. These include the right to a service provided with reasonable care and skill.

If digital content we supply damages your device or other digital content, and that happens because we did not use reasonable care and skill, we will repair the damage or pay you fair compensation.

17.5 Changes, suspension and ending your Account

We will only change these Terms, suspend your Account or end it for a valid reason, and with reasonable notice, as sections 13 and 15 explain. If a change is to your disadvantage, you can cancel before it takes effect and get a refund for any period you have paid for but not used.

17.6 Where you can bring a claim

These Terms are governed by the law of Scotland. If you live elsewhere in the UK, you keep the protection of the mandatory consumer laws of where you live, and you can bring proceedings in your local courts: in Scotland, the Scottish courts; in England and Wales, the English courts; in Northern Ireland, the Northern Irish courts. We will not sue you in any other country.
